These Terms & Conditions (“Terms”) govern your access to and use of our Job Portal, including job listings, employer services, candidate services, dashboards, and related features.
By accessing, registering, or using this Job Portal as an Employer, Recruiter, Candidate, or Visitor, you agree to be bound by these Terms. If you do not agree, please do not use the Job Portal.
1. Nature of the Job Portal
Scenical provides an online employment facilitation platform that enables:
- Employers to post job vacancies
- Recruiters to search and manage candidates
- Candidates to search, apply, and manage job applications
Scenical is not an employment agency, not a recruitment consultant, and does not guarantee employment, interviews, or job offers. We act solely as a technology-based intermediary.
2. Eligibility & Account Registration
- Users must be at least 18 years of age to register.
- Information provided during registration must be true, accurate, and complete.
- Each user is responsible for maintaining the confidentiality of login credentials.
Scenical reserves the right to suspend or terminate accounts found to be fake, misleading, inactive, or in violation of these Terms.
3. Employer & Recruiter Responsibilities
Employers and recruiters agree that:
- All job postings must be genuine, lawful, and accurate
- Job descriptions must not be discriminatory, misleading, or fraudulent
- No fees may be charged from candidates unless legally permitted and clearly disclosed
Scenical reserves the right to review, edit, reject, or remove any job posting without prior notice.
4. Candidate Responsibilities
Candidates agree that:
- Profile details, resumes, and documents submitted are truthful and updated
- Applications will be made only for legitimate employment purposes
- The Job Portal will not be used for solicitation, advertising, or spam
Candidates understand that final hiring decisions are made solely by employers.
5. Prohibited Activities
Users must not:
- Post fake jobs or fake profiles
- Upload viruses, malware, or harmful code
- Scrape data, copy listings, or misuse database content
- Use the portal for money laundering, scams, or illegal activities
Violation may result in permanent account termination and legal action.
6. Fees & Payments (If Applicable)
Some services may be offered on a paid basis, including premium listings or featured profiles.
- All fees are non-transferable
- Payments, once made, are non-refundable, unless explicitly stated
- Taxes and statutory charges shall be borne by the user
Separate commercial terms may apply for enterprise or bulk hiring services.
7. Verification & Compliance
Scenical may conduct:
- Email or phone verification
- Automated or manual moderation
- Compliance checks for misuse or fraud
However, Scenical does not independently verify employer credentials, job authenticity, or candidate qualifications.
8. Data Usage & Privacy
User data is handled in accordance with our Privacy Policy.
By using the Job Portal, users consent to:
- Storage and processing of resumes and profiles
- Sharing of candidate data with employers for recruitment purposes
- Communication via email, SMS, WhatsApp, or platform notifications
9. Third-Party Services
The Job Portal may integrate third-party tools such as:
- Email & SMS gateways
- Resume parsing services
- Payment gateways
Scenical is not responsible for outages, errors, or data handling by third-party providers.
10. Limitation of Liability
Scenical Ventures Pvt. Ltd. shall not be liable for:
- Job offer withdrawals or non-responses
- Employer or candidate misconduct
- Financial loss, data loss, or opportunity loss
- Disputes between employers and candidates
All interactions and hiring decisions are at usersβ own discretion and risk.
11. Indemnification
Users agree to indemnify Scenical against any claims, damages, or losses arising from:
- False job postings or profiles
- Breach of these Terms
- Violation of applicable employment or labor laws
12. Suspension & Termination
Scenical reserves the right to:
- Suspend or permanently disable user accounts
- Remove content without notice
- Block access for policy violations
Such actions may be taken without liability.
13. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of courts in India.
14. Modifications to Terms
Scenical may revise these Terms at any time. Continued use of the Job Portal constitutes acceptance of the updated Terms.
